Hearing Form Description

  • 3185 saw there was several boats on port heading towards the right hand gate mark so 3185 decided to drop the spinnaker  to allow for mark room for the overlapped boats on port.
  • 3017 was sailing on port, crash course with 3185, had no other option but to capsize to avoid collision with 3185. given 2130 was to leeward, this was 3017’s only option.
  • Once 3185 avoided 3017 (capsized boat), 3185 is now on a port starboard collision course with 2130 ( 3185 on starboard and 2130 on port both with dropped spinnakers)
  • 3185 was on crash course with 2130 (aiming for 2130’s port sidestay). 3185 recognised that they were not avoiding a collision, so 3185 bore away ( 2 boat lengths from right hand gate mark looking downwind), 2130 held their course resulting in their bow penetrating the starboard side of 3185’s bow, resulting in 3185 unable to sail for the remainder of the day. 

3185 was sailing on starboard gybe downwind on the layline to the right hand gate mark (looking downwind).

 

3185 as outside boat was required to give all the inside boats (including the ones on port) room to round the mark. (18.2(a))

 

However they are only entitled to MARK-ROOM which is room to sail directly to the mark and then round the mark. While “proper course” has no meaning in this context, mark room is essentially that - the course they would sail absent other boats to round the mark. 

Seamanlike manner means sail to mark, gybe, drop, head upwind.

 

 

However, as per above, 2130 did not round the mark in a seman like manner as detailed above, given that they were the inside boat and 3185 allowed for room for 2130 to round their mark being 3 boat lengths away.
