Procedural Matters

 

  1. AUS 525 was represented by Daniel Links

Facts Found

 

  1. The condition of 49er race 4 was 7 knots, flat seas.

  2. The preparatory signal for race 4 was flag P.

  3. Part of AUS 525’s hull was identified on the course side of the line at the starting signal.

  4. The race committee signaled individual recall by displaying flag x-ray and making 1 sound signal 10 seconds after the starting signal.

  5. AUS 525 decided not to return to the pre-start side of the line because the signal was made at 10 seconds after the starting signal and continued sailing.

  6. AUS 525 was scored OCS for race 4 by the race committee.


Conclusion

 

  1. It is an improper omission of the race committee to signal individual recall 10 seconds after the starting signal, however, AUS 525’s score in race 4 was made significantly worse through her own fault by not starting correctly. Therefore, the requirements for redress in RRS 61.4(b) are not met.
