Facts Found

 

1) The wind speed at the time of the incident was 20 knots and the sea state was choppy.

2) For the second Mark 1 rounding of Race 2, the jury vessel was four boat lengths upwind of Mark 1 with its bow facing the mark and with slight reverse to hold position.

3) 216149 was fetching the top mark on the starboard layline and was experiencing an issue with his mainsheet.

4) A gust hit 216149 and he continued to sail up towards the jury vessel.

5) The jury vessel went into forward throttle, turned starboard, and headed upwind away from 216149.

6) 216149 bore away astern of the jury vessel, sailed for two boat lengths, and capsized.

7) 216149 was in 3rd place approaching Mark 1 and finished in 6th place for Race 2.

8) There was no damage or injury. 


Conclusion

 

There was neither an improper action nor omission of the Jury. 216149’s place in Race 2 was not made significantly worse. Therefore, the requirements for redress in RRS 62.1(a) are not met.
