Facts Found

 

1. The wind was 12-13 knots and there were less than 0.5m waves.

2. Boat 41, on starboard tack, and Boat 11, on port tack, were sailing upwind in leg 1.

3. The boats were on converging courses.

4. Boat 11 held her course and when Boat 41 was around 2 boat lengths from Boat 11, she bore away to avoid contact.

5. Contact took place between the starboard bow of 41 and the starboard hull of Boat 11, behind the shrouds.

6. The mast of Boat 11 broke during the incident.

7. Boat 11 retired from the race.


Conclusion

 

1. Boat 11 on port failed to keep clear of Boat 41 on starboard, and broke Rule 10.

2. Boat 11 did not avoid contact when it was reasonably possible and broke Rule 14.

3. It was not reasonably possible for Boat 41 to avoid contact with Boat 11 when it became clear that Boat 1 was not keeping clear. Boat 41 did not break Rule 14.
