Facts Found | Procedural preamble: the hearing initially proceeded under 63.3(b) without 3028 as no representative was in attendance, however the hearing was restarted shortly after as a representative of 3028 then arrived. - At the warning signal for the start of Nacra 15 Race 7, 3028 was sailing in the starting area.
- At least two minutes after the preparatory signal was displayed, 3028 still remained in the starting area and was running on port approximately 5-10m to windward of the start line.
- 3028 sailed to windward of the start boat to leave the starting area and was notified by the PRO that she was in breach of the Sailing Instructions and that it was his intention to protest.
