Facts Found

 

  • 198 was sailing downwind towards the leeward gate.

  • 198 was on lay to the right hand mark.

  • About 25 seconds before reaching the gate, a support vessel crossed ahead of 198.

  • 198 bore away to avoid the support vessel and came off her foils and capsized.

  • There was no damage or injury.

On 18/04/2022, the Jury having decided that it may have made a significant error, reopened the hearing with 198 present. 


Conclusion

 

The jury originally conlcuded that "The requirements for redress in RRS 62.1(b) are not met."  Noting the provisions of Appendix B 62.1(b)(2), the original conclusion is in error and the requirements for redress are met.
