Facts Found| | AUS759 and J111 were sailing upwind on Starboard between BYS marks 2 and 4. J111 was clear astern and to leeward of AUS759. J111 gained an overlap 10 metres to leeward of ASU759. AUS759 was hit by a gust of 30+knots and heeled to leeward. AUS759 boom became entangled in the shourd and sidestay of J111 resulting in damage to the boom and mainsheet of AUS759 forcing her to reitre. At the time of the incident it was obvious to AUS759 that serious damage resulted. J111 did not take a penalty.

Conclusion| | When acquiring right of way through her own actions, J111 failed to initially give AUS759 room to keep clear, and broke RRS 15. AUS759’s score in race 5 was made significantly worse through no fault of her own by physical damage because of the action of J111, a vessel that was required to keep clear.
