Protest Submitted

Protesting on the basis of rule 11 and rule 17. 

On the start line, with about 10 metres til the start line, overlap was established by AUS 5225 by sailing to windward, from astern of AUS199. 
As such, AUS 199 was to leeward of AUS5225 as they both sailed towards the start line. AUS5225 began to bear away, sailing along the line, towards AUS199, in order to keep behind the start line, so as to avoid being OCS. AUS199 was on a more upwind course and called 'up' on AUS5225 three times to alert him to her presence below him and the need for him to avoid. When he didn't avoid, AUS199 avoided by stopping foiling and allowing AUS5225 to continue on his course and start. This was approximately 3 seconds before the start. After avoiding, AUS199 called 'protest AUS5225' twice but no penalty turns were taken by AUS5225. AUS199 notified the finish boat of intent to protest after the race.
