Procedural Matters

 

1. Lindsay Duthie, support person for Murray Duthie, attended the hearing as an observer.

2. 224252 was represented by Murray Duthie

3. Race Committee was represented by Nick Hutton

4. The request was delivered after the protest time limit. The Jury extended the time limit as there was good reason to do so.


Facts Found

 

1. The course axis was set for 270 degrees.

2. After the start, 224252 chose to sail to the right side of the course with approximately 50% of the fleet, with the others sailing to the left side of the course.

3. Aproximately 5 minutes after the start, a 30 degree wind shift occurred.

4. The RC reonfigured the course and signalled a change of course for leg 3.

5. 224252 finished the race.


Conclusion

 

1. 224252 score in race 7 was made significantly worse through her own fault, and there was neither an improper action nor improper omission of the the race committee. Therefore, the requirements for redress in RRS 61.4(b) are not met.
