Facts Found

 

1. Sailing downwind on starboard tack, 197531 was repeatedly rolling the boat, induced by in and out body movement, with no course change.

2. 197531 was first penalised under rule P1.2 for their breach of rule 42.2b. 

3. After getting well clear of other boats as soon as possible after she was penalised, 197531 luffed up and passed head to wind onto port tack, bore away and gybed onto starboard tack, luffed up again and passed head to wind onto port tack and bore away to continue sailing downwind.

4. 197531 was disqualified without a hearing.


Conclusion

 

1. 197531 failed to take a Two-Turns Penalty under rule 44.2 as required by rule P2.1

2. 197531 score in race 3 was made significantly worse through her own fault, and there was neither an improper action nor improper omission of the jury. Therefore, the requirements for redress in RRS 61.4(b) are not met.
