Procedural Matters

 
1. The hearing was held with two judges in person and two on-line.

2. 1449 did not ask to withdraw the protest after the arbitration meeting and neither boat took a Post-Race Penalty under RRS T1(a).

Facts Found

 

  1. 1449 rounded Mark 2 clear ahead of 1484 with both boats on starboard tack.

  2. 1484 sailing faster than 1449, established a windward overlap on 1449.

  3. 1449 altered course to windward

  4. The minimum separation between the boats' hulls was 2 metres.

  5. 1484’s spinnaker made contact with the starboard shrouds and spreader of 1449.

  6. 1449  bore away to avoid further contact

  7. The wind was approx 15kts and moderate sea state

  8. No boats took a penalty turn


Conclusion

 

  1. 1484 as the windward boat failed to keep clear of 1449 and broke RRS 11.

  2. 1484 did not avoid contact with 1449 and broke RRS 14(a).

  3. It was not reasonably possible for 1449 to avoid contact with 1484 and did not break RRS 14
