Facts Found | Wind at approximately 8 knots and the sea state was approximately 0.5 metres. At the start, before the pathfinder crossed in front of 9018 and 8817, 9018 maintaining steerage above close hauled on starboard. 8817 on port approached 9018 on a converging course. 8817 luffed and passed head to wind to leeward of 9018 and before reaching close hauled on starboard, 8817 luffed up to head to wind. There was contact between the starboard stern quarter of 8817 and the port bow of 9018. There was no visible damage to either boat. No boat took a penalty turn.

Conclusion | After passing head to wind and before being on a close-hauled course, 8817 failed to keep clear of 9018. 8817 broke RRS 13. 8817 did not avoid contact when it was reasonably possible, and broke RRS 14. It was not reasonably possible for 9018 the right-of-way boat to avoid contact with 8817 when it was clear that 8817 was not keeping clear. 9018 did not break RRS 14.
