  1. AUS 2873 did not come to the hearing, the hearing proceeded in accordance with RRS 63.1(b).

  2. The panel of the international jury was composed in accordance with RRS N1.4(b).

Facts Found


  1. Approximately 19 seconds prior to the start, AUS 2068 and AUS 2873 were overlapped and reaching on starboard tack, with AUS 2873 to windward of AUS 2068.

  2. Both boats were converging and on a collision course.

  3. When the distance between the two boats was half a metre, AUS 2068 bore away.

  4. There was no contact.

  5. Neither boat took a penalty.


Conclusion

 

AUS 2873 to windward failed to keep clear of AUS 2068 to leeward, and broke RRS 11.
