Procedural Matters


  1. USA 52 was represented by Antonio Sanpere.

  2. The panel of the international jury was composed in accordance with RRS N1.4(b).

Facts Found


  1. USA 52 was sailing out to the racing area and his centreboard made contact with the seabed.

  2. A fiberglass vessel was towing boats out and offered USA 52 a tow and he accepted.

  3. USA 52 did not raise his centreboard before being towed.

  4. While being towed, the centreboard of USA 52 contacted rocks and there was damage to the centreboard.

  5. USA 52 sailed in races 4 and 5 but decided not to sail in race 6.

  6. USA 52 sailed back to the shore and then discovered the damage to his centreboard.


Conclusion

 

USA 52’s place in races 4, 5 and 6 was made significantly worse through her own fault. Therefore, the requirements for redress in RRS 64.1(b) are not met.
