  2. AUS 3252 was represented by Kathryn Stephens (helm) and Jason Elwes (crew).

  3. Moira McGrath (support person to AUS 3252) attended the hearing as an observer.

Facts Found


  1. The Hansa 303 class rule C1.1(b) states: “RRS 49.1 is changed as follows: …The crew(s) torso shall be aft of the joystick except when making brief adjustments to control lines.”

  2. The definition of ‘torso’ is not defined in the rules. 

  3. Several current English dictionaries define ‘torso’ as “the trunk of the human body considered without head, arms, or legs.”

  4. AUS 3252’s torso was observed by the technical committee to be forward of the joystick several times whilst racing in race 3 and was not to make brief adjustments to control lines.

  5. Sailing instruction 15.2 states that when the “jury decides that a boat has broken rules related to functional adaptations, or a class rule, it may disqualify the boat, impose a lesser penalty or give a warning.”

  6. AUS 3252 was unaware that their torso might have been forward of the joystick whilst racing.


Conclusion

 

AUS 3252 failed to comply with class rule C1.1(b) and RRS 78.1.
