Facts Found

  1. The Hansa 303 class rule C1.1(b) states: “RRS 49.1 is changed as follows: …The crew(s) torso shall be aft of the joystick except when making brief adjustments to control lines.”

  2. The definition of ‘torso’ is not defined in the rules.

  3. Several current English dictionaries define ‘torso’ as “the trunk of the human body considered without head, arms, or legs.”

  4. FRA 3304’s torso was observed by the technical committee to be forward of the joystick several times whilst racing in race 3 and was not to make brief adjustments to control lines.

  5. Sailing instruction 15.2 states that when the “jury decides that a boat has broken rules related to functional adaptations, or a class rule, it may disqualify the boat, impose a lesser penalty or give a warning.”

  6. FRA 3304 was unaware that their torso might have been forward of the joystick whilst racing.
