Procedural Matters


  1. POR 3582 was represented by João Pinto.

  2. POL 3369 was represented by Piotr Cichocki and Olga Górnas-Grudzien.

  3. ESP 3724 was represented by Violeta del Reino and Jana Mestre.

  4. ESP 3590 did not come to the hearing, the hearing proceeded in accordance with RRS 63.1(b).

  5. ESP 8 did not come to the hearing, the hearing proceeded in accordance with RRS 63.1(b).

  6. The race committee was represented by Megan Kensington (Principal Race Officer).

  7. POR 3582, POL 3369 and ESP 3724 did not come to the hearing when the international jury gave the decision.

Facts Found


  1. The course to be sailed for race 1 of the Hansa 303 Two Person Dinghy was I2.

  2. During the first leg to mark 1, the wind shifted on each side of its course axis, but boats had to make more than one tack towards the mark.

  3. When the leading boats in the fleet were approaching the downwind gate (marks 4S/4P), the last few boats in the fleet had not rounded mark 1 for the first time.

  4. Throughout the rest of the race until the finish, although the wind was shifty, the relative positions of the fleet remained the same and did not invert. 

  5. According to sailing instruction 13, original marks will be used should the race committee decide to change the next leg of the course. 

  6. The race committee considered the options available to them and decided that the fairest option for all boats was to let the race continue.


Conclusion

 

There was neither an improper action nor improper omission of the race committee. Therefore, the requirements for redress in RRS 61.4(b)(1) are not met.
