Procedural matters:


  1. Martin Naef acted as an interpreter for FRA 3325.

  2. FRA 3325 did not ask to withdraw the protest after the arbitration meeting and neither boat took a Post-Race Penalty under RRS T1(a). 

Facts found:


  1. At the time of the incident, the wind was 6 knots and the sea was flat.

  2. The incident occurred on the 2nd beat for AUS 1594 and the first downwind for FRA 3325.

  3. FRA 3325 on starboard tack was on a contact course with AUS 1594 on port tack.

  4. When 1 boat length from AUS 1594, FRA 3325 luffed up to pass astern of AUS 1594.

  5. If neither boat changed course, FRA 3325’s bow would have made contact with the port stern of AUS 1594.

  6. There was no contact and no boat took a penalty.


Conclusion

 

AUS 1594 on port tack failed to keep clear of FRA 3325 on starboard tack, and broke RRS 10.
