Facts Found

 

1. Race 4, about halway down leg 3, 212857, in 3rd place, observed 220047 capsize.

2. 212857 saw the skipper of 220047 lying still in the water and hailed, "Are you OK?"

3. There was no response from the skipper of 220047 so 212857 sailed back upwind to help, and continued to hail 220047.

4. 217524, who was leading the race, also sailed back upwind to help 220047.

4. As 212857 got to 220047, the skipper of 220047 indicated she was OK.  212857 relayed this to 217524. 

5. A support vessel arrived to stand by and 220047, and 212857 and 217524 resumed racing.

6. 212857 finished in 8th place and 217524 finished in 1st place.


Conclusion

 

1. 212857 score in race 4 was made significantly worse through no fault of his own by giving help in compliance with RRS 1.1 to someone other than himself. The requirements for redress in RRS 62.1 are met.

2. 217524 score in race 4 was not made significantly worse through no fault of his own by giving help in compliance with RRS 1.1 to someone other than himself. The requirements for redress in 62.1 are not met. 

3. The actions taken by Miles Greenwood, the skipper of 212857, and Aiden Simmons, the skipper of 217524 are to be commended.

Decision

 

Redress is given to 221857. 221857 is to be scored points equal to the average, to the nearest tenth of a point (0.05 to be rounded upward), of her points in races 1, 2 & 3 (Appendix A9(b)). No other boats scores shall; be affected.
