Facts Found

 

1. The preparatory signal for the World Championship Fleet had been displayed for race 10.

2. The Promotional Fleet was finishing race 9.

3. During that time, David Suda drove his rib between the starting line for the World Championship Fleet and the finishing line for the Promotional Fleet.

4. The distance between the above starting line and the finishing line was approx 90m.

5. David Suda's daughter is a participant in the World Championship Fleet.

6. David Suda accepted that he had broken a rule of the SI, he offered a sincere and unconditional apology and gave an assurance that there would be no recurrence.


Conclusion

 

1. David Suda being the parent is a support person, in accordance with RRS Definitions, Support Person.

2. By not staying outside the starting area where boats are racing from the time of the preparatory signal for the first fleet until all boats in remaining fleets have finished or retired or the race committee signals a postponement or an abandonment for all fleets racing, David Suda did not comply with SI 23.1

3. The apology rendered by David Suda and the assurance given by him justified  mitigating the penalty.

Decision

 

David Suda was warned under RRS 64.4(a)(1) for the breach and informed that a penalty may be imposed on the boat he supports if he commits a further breach of any rule.
