Facts Found

 

  1. Kite Foil Race 10 was conducted on a LR2 course, with 12 to 15 knots of wind and short chop sea state.

  2. Board 16 was on port, Board 13 on starboard.

  3. Board 13 bore away to gybe onto port tack more than 30 metres from mark 4P and capsized.

  4. When Board 13 capsized, Board 16 was unable to avoid Board 13.

  5. Board 16 capsized and made contact with the lines of Board 13.

  6. Board 13 retired from the race.

  7. Board 16 recovered and finished in 6th position. 

  8. Board 16 incurred no physical damage.


Conclusion

 

  1. When Board 13 changed course she did not give Board 16 room to keep clear. Board 13 broke rule F2 16.1.

  2. It was not reasonably possible for Board 16 to avoid contact with capsized Board 13. Board 16 did not break rule 14 or F2 22.1.

  1. No further penalty is awarded to Board 13 as she retired.

  2. Board 16’s request for redress is denied as there was no physical damage in this incident.
