Hearing Decision

At the start of race 6 under P flag the race committee identified TUR 21 as being over the line at the time of the starting signal. 

The race committee signaled an individual recall at least 13 seconds after the starting signal.

TUR 21 was not aware she was over the start line at the starting signal.

TUR 21 checked that there was no signal shown on the pin end boat and also checked a few seconds after the starting signal that there was no signal shown on the starting vessel.

TUR 21 did not return to start correctly.

TUR 21 finished the race 1st place.

There were two other races in the same conditions on that day where TUR 21 finished 4th and 12th.

The race committee failed to comply with RRS 29.1 as it failed to display flag X and make one sound signal promptly.

TUR 21 had no reason to believe that she was over the start line at the start signal.

By scoring TUR 21 as OCS, the score of TUR 21 was made significantly worse by no fault of her own.

As TUR 21 would have had to return to start correctly she would have not finished in her original finishing position.

Redress is given to TUR 21.

TUR 21 is given a score of 12 points in race 6, not changing the score of any other boat.

When making this decision the jury assumed that if TUR 21 had returned to start correctly, she would not have finsished in a better position than in the worst other race she sailed on that day.
