Facts Found

 

  1. 2199 was sailing downwind on starboard.

  2. 2131 was sailing downwind on port on a collision course with 2199

  3. 2199 attempted to keep clear by luffing. 

  4. Contact occurred between the spinnaker pole of 2199 and the stern of 2131 causing the spinnaker pole to break and holing the stern of 2131.

  5. Both boats retired from the race and 2199 was unable to compete in the following race.


Conclusion

 

  1. 2131, a port tack boat, failed to keep clear of 2199, a starboard tack boatcausing serious damage.

  2. It was not reasonably possible for 2199, a right of way boat, to avoid contact when it was clear that 2131 was not keeping clear.

  3. The score of 2199 was made significantly worse by physical damage caused by the action of a boat that was breaking a rule of Part 2 and is entitle to redress.
