Facts Found

 

  1. 1771 on port tack was involved in an incident with 1458 0n starboard. Contact was made between the two boats resulting in serious damage to 1458.

  2. 1771 was found in the original hearing to have broken RRS 10 & RRS 14.

  3. The incident occurred during the starting sequence of race 4. Just after the lowering of the prepatory signal.

  4. 1771 a two turn penalty before the start of the race was postpone. 


Conclusion

 

  1. As the contact resulted in serious damage 1771's penalty was to retire in accordance with RRS 44.1(b).

  2. Rule 36(b) was also applicable.

As the reopening of the hearing is unlikely to alter the decision of the original hearing the request to reopen the hearing is denied.
