- 20 seconds prior to the start, boat 20 reached down into a position to windward of boat 08 with both boats on starboard.
- Throughout this maneouvre, boats 08 and 20 were overlapped with boat 20 to windward.
- Both boats were positioned with enough room to clear the starting mark and its anchor line if there had been no contact.
- At approximately the time of the starting signal, boat 08 called "Up, up, up" to boat 20, without changing course.
- There was contact between the skipper of boat 08 and the shroud of boat 20.
- The skipper of boat 08 fell off the boat, which then drifted astern and made contact with the pin end starting mark.
- No penalty was taken by either boat.

Conclusion| | Boat 20 to windward failed to keep clear of boat 08 to leeward. Boat 20 broke rule 11. Boat 08 broke rule 31; however, since this was caused by another boat breaking a rule of part 2 she is exonerated under rule 64.1(a).
