Facts Found| | - Mixed keelboat fleet race around fixed marks.
- Wind approximately 6kts North, flat seas.
- Fixed start line laying approximately North-South
- Jinja and Serifa 2 approaching the start line from the West. Jinja reaching.
- Serifa 2 approximately 5 boat lengths to leeward of Jinja close reaching on a converging course, approximately 30 seconds from the start.
- Serifa 2 established an overlap to leeward of Jinja by reducing the lateral separation.
- Serifa 2 continued to sail on a converging course with boats overlapped.
- Both boats travelling similar speed, about 5 kts.
- Serifa 2 called Jinja “up” and “don’t go in there”.
- Jinja did not alter course to avoid Serifa 2.
- When it was apparent that Jinja was not responding, Serifa 2 bore away below Jinja on a course to the first mark.
- Serifa 2 immediately hailed “protest” and flew a protest flag.
- There was no contact. Neither boat took a penalty.
