Facts Found

 

  1. The last boat to finish the CBA Portsea Cup race on 09/04/22 was recorded as finishing at 15:33:04

  2. On 09/04/22 at 21:05 the skipper of Mystify sent an email to the race committee querying the handicapping of C97

  3. On 10/04/22 at 13:27 the race committee replied to the skipper.

  4. On 11/04/22 at 15:10 the skipper of Mystify sent an email with “a letter for a Request for Redress against the SSCBC’s handicapping committee”

  5. Neither party provided a good reason as to why the request was not delivered sooner.


Conclusion

 

  1. NoR/SI 23.2 states “The protest time limit and redress time limit is one hour after the last boat has finished the last race of the day. “or two hours after the incident, whichever is later” is deleted from rule 62.2.

  2. NoR/SI 23.3 states “A request for redress based on an incident identified in a scoring enquiry will meet the time limit if:

    a) the scoring enquiry was delivered within the time limit specified as changed by SI 23.2; and

    b) the request for redress is delivered as soon as reasonably possible after being notified of the race committee’s response to the scoring enquiry.

  3. The initial query is a scoring enquiry, and was not delivered within the time limit as required by NoR/SI 23.2

  4. The request for redress was not delivered as soon as reasonably possible after being notified of the race committee’s response to the scoring enquiry, as required by NoR/SI 23.3(b).

  5. There is no good reason to extend the time limit.
