Procedural Matters

 

  1. Ben Fels declared that he was in Div 1. race but that since his boat had won the race he did not see a conflict of interest. The parties agreed.

  2. The protest form was lodged at 16:43 the Protest time limit was 17:15

  3. It was obvious at the time of the incident that serious damage had resulted and C33 informed C1992 of her intention to protest before the protest time limit.

  4. The protest is valid.

 

Facts Found

 

  1. 15 kts, flat seas TW5 course.

  2. Div 2 boats C33 overlapped to windward of C1789 was broad reaching from mark X1 to mark 2 on starboard. 

  3. Div 1 boat C1992 was close hauled on port heading  to mark 1 on a converging course with C33.

  4. C33 hailed starboard approx. 5 times with increasing urgency.

  5. C1789 bore away to give room to C33 to bear away to avoid contact.

  6. C1992 broke their tiller and did not change course when the skipper went to look below.

  7. Before it became clear that C1992 was not keeping clear, C33 sprung sheets to bear away. 

  8. C33 bore away and had bowsprit contact with C1992’s hull and penetrating it and creating a large hole. C33s mast, bowsprit and stem were extensively damaged.

  9. There were no injuries.

  10. Both boats supported each other calmly and politely to recover the boats to shore.

 

Conclusion

 

Protest Conclusions


  1. C1992 on port tack failed to keep clear of C33 on starboard tack, and broke RRS 10.

  2. C1992 did not avoid contact with C33 even though it was reasonably possible, and broke RRS 14(a).

  3. It was not reasonably possible for C33 the right-of-way boat to avoid contact with C1992 when it became clear that C1992 was not keeping clear. C33 did not break RRS 14(a)


Redress Conclusions


  1. C33’s score in A3 Trophy Series was made significantly worse through no fault of her own by physical damage because of the action of C1992 that was breaking RRS 10 and was penalized.

Decision

 

  1. C1992 is DSQ in race 1.

  2. Redress is given to C33. C33 is to be scored in A3 to A5 points equal to the average, rounded to the nearest tenth of a point (0.05 to be rounded upward), of her points in Trophy series A1, A2, A6 and A7. No other boat’s score shall change.

  3. If C33 is able to race before the end of A5, those scores shall be used instead of the RDG above.
