Hearing Decision

1. GBR512 approached the finish line on starboard tack


2. MEX11 approached the finish line on port tack on a collision course with GBR512


3. GBR512 attempted to avoid a collision, but collided with MEX11 on the stern and fell in the water, but remained attached to the boom


4. MEX11 performed a penalty turn


5. MEX11 did not sign the penalty acknowledgement form


6. A witness close in front of GBR512 prior to the incident finished in 36th place, GBR512 finished in 39th place and MEX11 finished in 41st place.

MEX11 was required to keep clear of GBR512 under rule 10 & 14. GBR512 did not comply with rule 14, but is exhonerated. MEX11 is exhonerated for infringing GBR512 on the water, but failed to declare her penalty turn as required by SI 12.1.
