Facts Found | - When the starting signal for Race 1 was made, the race committee (RC) observed three boats OCS, including AUS 38.
- The RC promptly displayed the individual recall signal flag with a sound signal, then lowered the flag once two of the boats re-started.
- Shortly thereafter the RC re-hoisted the individual recall signal flag without a sound signal.
- After she crossed the starting line AUS 38 continued sailing the course.
- The RC scored AUS 38 OCS in Race 1.

Conclusion | - Because the race committee lowered the individual recall signal flag, AUS 38 had no way of knowing that she was OCS at the starting signal.
- The race committee’s lowering of the individual recall signal flag was an improper action which made AUS 38’s score significantly worse through no fault of her own.
