Facts Found

 

1. 9550 on STBD, 2742 on Port on converging course.

2. 2742 tacked to STBD and completed her tack 1m clear ahead of 9550.

3. 2742 capsized.

4. 9550 collided with 2742.

5. The crew of 2742 was injured.

6. Wind was approx 20 knot with significant wave condition.

7. 2742 retired from the race.

8. 9550 finished the race but retired from the following race.

9. Neither boats did a penalty turn.

 


Conclusion

 

2742 was required by RRS 15 to give 9550 room to keep clear once she had completed her tack.

2742 completed her tack within 1m of 9550 which was not sufficient in the conditions to provide 9550 room to keep clear.

Decision

 

2742 breached RRS 15 but as she retired no further penalties.

It was not reasonably possible 9550 to avoid the collision and is therefore exonerated from RRS14
