Facts Found

 

AUS 53662 did not hail 'protest' but suffered a broken trapese wire which may have  been serious damage. As result, the protest committee protested under rule 60.3(a)1

53662 was close hauled on starboard tack and on a converging course with 53661, running under spinnaker on starboard tack.

When there was no response to her hail, 53662 bore away to avoid contact, passing close to 56331. This caused the fwd hand to be dumped in the water and the trapese wire to be broken.

 

 


Conclusion

 

53661 did not keep clear as required by rule 11

When the trapese wire was broken as a result of 53661 breaking rule 11, 53662 suffered serious damage which made her finishing position significantly worse through no fault of her own.

Decision

 

53661 is disqualified. 

Redress is granted to 53662 who is to is to be scored average points in accordance with rule A10 (b) applied to races 1 to 10.
